|user of the Website, who books a vehicle for rent on conditions provided herein;
|user of the Website, legal proprietor of a vehicle provided for rent on conditions provided herein;
|means Rentacarclub.com’s a company incorporated in Thailand (under company registration number 0205560010403 ), whose registered office is at 64/70 Moo 12, Nongprue, Bang Lamung, Chon Buri.
1. GENERAL PROVISIONS
1.1 Rentacarclub.com provides trusted and excellent rental car bookings to customers. Thus, a customer reserving a car with Rentacarclub.com abides by & accepts the Terms & Conditions as follows.
The Services provided by Rentacarclub.com allow Owners to create a list of their vehicles available for rent and allow Renters to make a booking for their preferred vehicle directly from the Owners.
1.3 Rentacarclub.com does not own any of the cars, which are available for rent, unless otherwise directly expressed in the description. Rentacarclub.com acts as a broker, connecting the Renter and the Owner and allowing them to conclude a direct deal between each other.
1.4 These Terms and Conditions might be changed from time to time by Rentacarclub.com, therefore both Renters and Owners, as well as other users, must check our Website to keep a check on any modifications or changes to the terms and conditions applying on relevant party.
1.5 Any booking made by the Renter through this Website is liable to these Terms and Conditions and confirms the Renter’s acceptance of the terms and conditions of the Owner, of which car rental service is booked by the Renter through this Website.
1.6 Any booking made on this Website by the Renter depends on their own will. In case you, as a Renter, do not approve any part of our Terms, you must not continue your booking with us. By making any booking with this Website, you indicate or confirm that you have gone through the relevant Terms and accept them. For any Term that you do not understand or wish to enquire about, contact us at 0991212012 or via e-mail email@example.com.
1.7 We, as the Broker, will notify the Renter about the availability of the requested vehicle by emailing a booking confirmation voucher if the Renter’s offer has been accepted. In a situation, where the car type or car model booked is not available with our Owners, we will be informing the Renter with possible alternatives, which, if accepted by them, shall be incorporated in the Renter’s current booking by modifying it and will be nailed to the Owner for consideration. If not accepted, we hold the right to cancel the booking and refund Renter’s deposit, if any.
1.8 Please note that you, the Renter, will not have any contract for car rental at the price offered until your booking has been confirmed and the necessary payment has been received. If you have any question, please feel free to contact us. Please note that any contract entered into will be with the individual actually booking the vehicle, and all the correspondence will be sent to the address given, even where a third party actually pays for the hire.
1.9 You, the Renter, must present your voucher to the car Owner when you pick up your rental vehicle. Rentacarclub.com will not be held accountable under any circumstances for any rejected rental services, in case of your failure to provide the Owner with your car rental confirmation voucher at the time of pick up.
1.10 Rentacarclub.com does not bear any responsibility for any charge incurred due to documents signed for and accepted at the local level. For any damage caused to the rental vehicle by any person driving under the influence of alcohol or drugs, off-road driving or driving carelessly, Rentacarclub.com should not be held responsible. You, as the car Renter, will take full liability in respect of such claims or situations.
1.11 Although we strive to ensure the accuracy of the information on this Website, neither we nor our affiliates, Owners or others can be held responsible by you for the accuracy of such information. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all the information provided on this Website.
2. REGISTRATION AND PERSONAL ACCOUNT
2.1 Anyone, who meets the requirements herein, at its sole discretion, may become a user of Rentacarclub.com services by creating their personal account.
2.2 Owners may become Users of Rentacarclub.com services by submitting their details and listing their vehicles available for rent within the Website. Using of services by the Owner will be subject to their confirmation that their vehicles meet the car requirements.
2.3 Renters may become Users of Rentacarclub.com services by filing an application form providing their details and describing their preferred vehicle. Using of services by the Renter will be subject to their confirmation that they meet the requirements as a driver.
2.4 Rentacarclub.com always keeps the right to refuse any application of both Owners or Renters on their sole discretion.
2.5 Once becoming a User the relevant party must keep their details up to date. Any information provided by Users must be accurate and true, any contact detail must be personal.
3. BOOKING CONDITIONS
Please read carefully the following booking conditions, which apply to bookings made by Renters for vehicles through Rentacarclub.com.
3.1 Making a Booking
3.1.1 The Renter pays the entire rental cost of the rented vehicle at the time of making a booking and after that only pays for fuel petrol/ diesel and optional extras on arrival.
The payment model is unchangeable and cannot be modified by the Renter and/or the Owner on their own. The Renter will be informed of any upfront payment prior to completing the booking. Where applicable the Renter is responsible for paying the balance owing to the Owner.
3.1.2 At all times Renters are responsible for payment of any additional service requested by them and they are responsible for any other service charge applied by the Owner. Renters must use a credit to make a booking through Rentacarclub.com.
3.1.3 If the Renter needs to make any alterations to their booking, Rentacarclub.com must receive a communication through the following e-mail firstname.lastname@example.org or the Website support form, clearly informing Rentacarclub.com of the precise details of such alteration. Rentacarclub.com does not guarantee that said alterations can be processed; however every effort will be made to meet with a favourable outcome. Alterations cannot be processed after the vehicle’s pick up.
3.1.4 Rentacarclub.com is unable to offer the Renter a refund if they end their rental early.
3.1.5 In the event that the Renter requires to extend the rental period after the collection of the rented vehicle, in case of acceptance of such extension by the Owner, the Renter must pay an additional fee, determined by Rentacarclub.com.
3.1.6 On making a booking/reservation it is the Renter’s responsibility to inform the Owner about necessity of any physical or mental condition relevant to the vehicle rental.
3.1.7 In the event of an accident, there may be insurance implications if the Renter fails to inform the Owner of the condition.
3.1.8 The Renter must present, on collection of the rented vehicle, a full driver’s license from the country of origin, a valid passport and a valid credit/debit card in the Renter’s (driver’s) name. In the event of a failure to present the required documents, the Owner may refuse to provide the car, and no funds paid will be reimbursed to such Renter.
3.1.9 If the Renter makes a booking but does not collect the vehicle, no funds paid will be reimbursed. Please be advised that in the event of a delayed arrival it is the Renter’s responsibility to contact the Owner.
3.1.10 If your, as a Renter, booking has been accepted by the Owner, but at the time of your car’s pick up the Owner insists on providing you with any other alternative car with higher or lower value or refuses to provide you with the originally booked vehicle. Any such issue should be dealt by you, the Renter, with the Owner directly or with the Owner’s staff at the pick up location. Should both parties not be able to resolve the issues between eachother. We, Rentacarclub.com, will be responsible for contacting with the car owner in handling any dispute and complaints e.g. failing to provide the chosen car, delayed arrival of the car owner, refunds and cancellations.
3.1.11 Rentacarclub.com is only a car rental service facilitator, which acts as a broker between you, the Renter, and the Owner. By using our services you agree and accept that Rentacarclub.com is not responsible for any damages, extra charges or expenses, other than the rental costs, caused in any form, either by you or the Owner.
3.1.12 In situations, where Rentacarclub.com is responsible for any refund, the liability of the refund amount by Rentacarclub.com is only up to the deposit made by you, the Renter, online at the time of the booking.
3.2 Confirmation of Booking
3.2.1 When your booking is confirmed, Rentacarclub.com will issue the booking confirmation on behalf of the Owner for each booking, but does not undertake to include charges for additional services or details of the service charge or taxes charged by the Owner or additional services requested by you at the collection point.
3.2.2 Rentacarclub.com recommends that you thoroughly check the details of the booking (e.g. location and rental period). If there are any discrepancies, you should immediately send a communication through our Website form or following email email@example.com, clearly informing Rentacarclub.com of the exact details of discrepancies.
3.2.3 Rentacarclub.com advises that you read and comply with the Owner’s terms and conditions (which are available in the description, but may be changed by the Owner from time to time) upon which the Owner makes the reserved vehicle available to you upon receipt of the booking confirmation.
3.2.4 The reservation number from the booking confirmation should be quoted in all enquiries, cancellations or modifications of the booking.
3.3.1 If you wish to cancel a booking, the only accepted method is through the Website form. Do not cancel your booking with the Owner directly as additional fees may apply.
3.3.2 Where Rentacarclub.com receives a cancellation notice within forty-eight(48) hours of the date when the car rental was booked, all funds minus 10% provided herein will be reimbursed to you. There is no refund made after the (48) hours prior the date when the car rental was booked.
3.3.3 It is the Renter’s responsibility to personally cancel any other ancillary product that they may have purchased in conjunction with the booking.
3.3.4 In the event that you cancel or amend a booking Rentacarclub.com will not be liable for any monetary losses suffered by you as a result of a change in monetary exchange rate between the time of your original booking and its subsequent cancellation or amendment (as applicable).
3.3.5 No cancellation is permitted after the date when the booking is due to commence.
3.3.6 Rentacarclub.com may, at its sole discretion, cancel the booking and give the Renter a refund (reduced for an amount of administration fee) in the following cases:
- serious illness of the Renter, which hinder the Renter to drive;
- natural disaster;
- adoption of acts or restraints of governments or public authorities;
- war, riot, civil commotion or acts of terrorism.
3.4.1 Rentacarclub.com makes all the efforts to ensure that the prices quoted at the time of booking on the Website are accurate in all material respects. Nonetheless Rentacarclub.com reserves the right to amend the price quoted at the time the booking is made in the event of a manifest or latent error in the price quoted.
3.4.2 Rentacarclub.com will endeavour to notify the Renter as soon as possible in the event that the price quoted at the time of the booking is incorrect.
3.4.3 In the event of a change of the price quoted at the time of the booking the Renter may elect to pay the amended price or alternatively the Renter will be entitled to refund all the sums paid.
3.4.4 The foreign exchange rates are used by Rentacarclub.com to display prices in the currency chosen by the consumer, and are updated frequently. The foreign exchange rates used by your credit/debit card company may vary. Rentacarclub.com cannot be held responsible for any discrepancy between the price displayed by Rentacarclub.com and the amount charged by your credit/debit card company due to the rate of exchange used.
3.4.5 The Owner may choose either recommended rental price or their own. Rentacarclub.com’s recommended rental price is the total price of the car divided by 1000 per day. The Owner’s own price cannot be less than the recommended price.
4. RENTAL PERIOD
4.1 The Rental period is a period of exclusive right of the Renter to use the vehicle. The Rental period is chosen by the Renter during the process of booking. Any changes or alterations to the Rental period must be done through the Website form under the conditions provided herein.
4.2 All periods are calculated by days. In case of booking the vehicle for less than 24 hours, the Renter will be charged for 24 hours.
4.3 If the Rental period exceeds 20 days, both Rentacarclub.com and the Owner remain the right to inspect the vehicle periodically and to stop violations in use, if any.
4.4 All the Rental period extensions must be done through Rentacarclub.com The violation of this clause may be subject to the financial liability of both the Owner and the Renter.
4.5 Late return of the vehicle without requesting a Rental period extension will be subject to the charge provided herein.
5. RESONSIBILITIES OF THE PARTIES
5.1 The Renter’s responsibilities
5.1.1 Renters are responsible for inspecting rented vehicles prior to leaving the place where the vehicles are picked up. Once the Renter leaves the rental facility with the vehicle, any damage found is the responsibility of the Renter.
5.1.2 The Renter will not operate a vehicle that the Renter suspects is not operating properly. The Renter will park the vehicle and make appropriate arrangements so that the vehicle can be serviced or towed.
5.1.3 Renters must only transport the number of persons for which there are seat belts in the vehicle. The Renter must make certain that all the persons in the vehicle wear their seatbelts.
5.1.4 Renters must observe all the traffic regulations. Renters are personally responsible for any traffic citations that may be issued as a result of operating a vehicle.
5.1.5 Renters must take appropriate precautions when driving conditions are hazardous. (This includes, but is not limited to dust storm, fog, heavy rain, snow, or ice conditions). This includes a calculation of sufficient time for the travel.
5.1.6 Renters are responsible for taking appropriate measures to secure and safeguard the vehicle until it is returned to the designated location or the Owner’s place. In cases where the rental vehicle is used, the Renter is responsible for complying with all the rules and regulations associated with the vehicle.
5.1.7 Before returning the vehicle, the Renter must ensure that the Vehicle is clean and corresponds to the condition at the start of the Rental period, and the Renter must remove any debris, rubbish and the Renter’s personal items from the vehicle.
5.1.8 The Renter must not transfer the vehicle to any third party.
5.2 The Owners’s responsibilities
5.2.1 All the Owners must be the registered keepers of the Vehicles. No arrested or restricted in use vehicles are allowed to be provided by the Owners. While listing their vehicles available for rent, Owners must provide documentation to evidence their property ownership.
5.2.2 The Owner must deliver the vehicle to the place of its transfer to the Renter at the agreed time and date, which are confirmed by the booking confirmation.
5.2.3 The Owner must guarantee that the vehicle is fully functional on the date of the start of the Rental period. At the moment of transfer the Owner must allow the Renter to inspect the rented vehicle’s parts, including but not limited to mirrors, tyres, pedals and hand-brake, windows, seats and seat belts, electronics, washers, indicators, fuel tank, etc. The vehicle must not provide excessive or unusual noise.
5.2.4 All the parts must meet the conditions provided in the vehicle’s description.
5.2.5 Before transferring the vehicle, the Owner must ensure that the Vehicle is clean, and the Owner must remove any debris, rubbish and the Owner’s personal items from the vehicle.
5.2.6 All the vehicle’s defects (as scratches, bumps, dents, etc.) must be documented and signed by both the Owner and the Renter during the transfer of the vehicle.
5.2.7 In case of any unforeseen problem with the vehicle, the Renter may request a cancellation of rent and ask for a full or partial refund.
5.2.8 The Owner must verify the identity of the Renter at the moment of transfer. The Owner must make a copy of the Renter’s driving licence. Rentacarclub.com may at any time request a copy of such driving licence. If the Owner fails to provide the copy of the Renter’s driving licence, Rentacarclub.com keeps the right to refuse any payment to the Owner.
5.2.9 The Owner must provide a third party liability insurance for all the vehicles listed available for rent. If requested by Rentacarclub.com, the Owner will provide reasonable evidence to prove this.
6. RESPONSIBILITIES OF ALL USERS
In addition to clause 5 all of the users of the Website are obliged to adhere to the following rules.
6.1 None of the users should:
6.1.1 perform any act prohibited by state or local law, or assist in this to third parties;
6.1.2 provide any information or post any data, which is not accurate or true;
6.1.3 use or represent any information, picture or other content, which is an intellectual property of Rentacarclub.com or any other third party protected by law;
6.1.4 provide false or fake documents;
6.1.5 avoid paying any charge or fee provided herein;
6.1.6 use the Services to find contact information of the Owners or Renters in order to conclude a direct deal with the relevant party without paying Rentacarclub.com’s commission;
6.1.7 transfer in any form their user’s account data (including login and password) to third parties;
6.1.8 collect or use other users’ personal or payment data without their prior written consent;
6.1.9 offend in any way other users of the Services;
6.1.10 use Services in order to commit an offense in relation to other users or third parties;
6.1.11 post any spam information on the Website;
6.1.12 use Services to advertise their own services or make others believe as if they are the representatives of Rentacarclub.com or providers of the Services, while they are not;
6.1.13 make any payment related to the Services outside of the Website;
6.1.14 interfere with the operation of the Website (including any DDoS attack, virus, bot, etc.) or activities of any account;
6.1.15 use Services in order to legalize the funds obtained by criminal means;
6.1.16 copy or use, without Our prior written consent, the Website’s source code or any content;
6.1.17 create another account if their previous account was closed because of violations of these Terms.
7. RENTER CHARGES
7.1 While using Our Services the Renter shall pay the following fees and Rentacarclub.com will collect any payment on behalf of the Owner as their authorized agent:
7.1.1 the Rental Price;
7.1.2 the Renter’s Fee;
7.1.3 the Insurance Fee calculated according to selected by the Renter insurance conditions;
7.1.4 extra fees in case of using additional services by the Renter;
7.2 The following additional charges are also applied to the Renter:
7.2.1 Late Return Fee;
7.2.2 Excess Km Fee (if agreed with the Owner);
7.2.3 Refuelling Charge (if agreed with the Owner);
7.2.4 Cleaning Charge (charged in case of the Vehicle is returned dirty, in sand, mud, or there is an evidence of unauthorised smoking or unauthorised pets);
7.2.5 Key Replacement Charge (in case of losing or breaking the keys);
7.2.6 Locksmith Charge (in case of need);
7.3 The amount of any additional charge is specified in section 22.
7.4 The Renter should also reimburse any state or local penalty applied to the Owner because of improper use of the Vehicle by the Renter. Such payments may be automatically charged by Rentacarclub.com from the Renter’s account and/or credit/debit card.
7.5 Any other charge, which is not regulated by these Terms, but was agreed by the Renter and the Owner, must be only paid through the Website.
7.6 Before the Rental period Rentacarclub.com will charge a Security deposit from the Renter’s credit/debit card in order to guarantee the Renter’s compensation of losses caused by violations of the vehicle’s use terms. In case of returning the vehicle in proper condition and in compliance with these Terms, if there are no complaints from the Owner, the Security Deposit will be returned to your credit/debit card within five (5) business days from the date of the end of the Rental period.
7.7 In case of any deposit made by the Renter exceeds the total price (including Rental price, service fees, extra fees and additional charges) the difference will be refunded to the Renter.
7.8 In case of any deposit made by the Renter is less than the total price (including Rental price, service fees, extra fees and additional charges), the Renter will be obliged to pay the difference within five (5) business days from the date of the end of the Rental period.
7.9 By this the Renter irrevocably, fully and permanently authorises Rentacarclub.com to charge any amount according to these Terms from the Renter’s credit / debit card, which is connected to the Renter’s account. In case of collecting any amount from the Renter’s credit / debit card Rentacarclub.com will inform the Renter about such collection two (2) business days prior to the date of collection. During this period the Renter has the right to appeal and challenge such collection providing adequate justification.
8. FINES AND OTHER CHARGES
8.1 In addition to section 7 the Renter shall be also liable for the following fines and charges, which arose during the Rental Period:
8.1.1 any penalty related to the traffic offence;
8.1.2 any penalty related to causing harm to any third party while using the vehicle;
8.1.3 any parking charge (unless other agreed by the Renter and the Owner).
8.2 It is the Renter’s sole responsibility to pay such penalties directly to the harmed person, unless other stipulated herein or in the current law. Before returning the Vehicle the Renter must inform the Owner about any harm caused to third parties while using the vehicle and any penalty related to this.
8.3 In case of receiving any inquiry from authorized state bodies regarding the vehicle, both the Owner and Rentacarclub.com have the right to pass the details of the Renter to such body.
9.1 By using Our Services all the Owners authorise Rentacarclub.com to collect any payment related to the Services from the Renter in accordance with these Terms.
9.2 Rentacarclub.com will pay the following amounts to the Owner:
9.2.1 the Rental Price minus Owner’s Fee;
9.2.2 the amount of any fee, charge or fine collected from the Renter minus Rentacarclub.com’s interest provided herein.
9.3 All the payments to the Owner will be made within fourteen (14) business days from the date of the end of the Rental period.
9.4 All the payments due will be made to the bank account of the Owner. The Owner must provide Rentacarclub.com with a true and valid bank details. Failure to do so for twenty-one (21) days from the date of the end of the Rental period will be deemed as the Owner’s refusal to receive the payment.
9.5 All the payments to the Owner will be only made after receiving the sums from the Renter.
9.6 Rentacarclub.com will be responsible for any bank commission unless other agreed by the Owner and Rentacarclub.com.
9.7 The Owner shall be solely responsible for counting and paying any tax related to the funds received from Rentacarclub.com or other parties in relation to the Services.
10. COLLISION DAMAGE WAIVER, THEFT WAIVER, ACCIDENTS
The Insurance is applicable to all the bookings. Users must review the insurance policy and be informed about any restrictions and exclusions which may apply. By using Our Services users accept the insurance policy and undertake to adhere it.
10.1 Collision Damage Waiver reduces your legal responsibility from the total damage cost to a surplus amount applicable, except if the damage caused by you is intentional and/or under the influence of drugs/alcohol; or if you use the vehicle in a negligent way, such as renting it to other parties or driving off main roads.
10.2 Collision Damage Waiver also covers charges for damage to the rented vehicle or its accessories. In some cases replacement of windscreens, undercarriage, keys, tyres, locks as well as towing charges are not covered by the insurance policy.
10.3 Theft Waiver reduces your legal responsibility in the event of thievery or damages caused due to attempted theft or theft of the vehicle. Any sort of negligence associated with the theft of the rented vehicle could lead to the car Owner’s request of the complete refund of the full cost of the rented vehicle.
10.4 In case of an accident the Owner or the Renter must immediately inform Rentacarclub.com
10.5 In the event of violating this clause Rentacarclub.com will not be responsible for any loss and will not have to take a part in any procedure related to such accident.
10.6 In the event of an accident the Renter must not be responsible unless otherwise advised by the Insurer.
10.7 The Renter must provide the following information in order to comply with the insurance rules:
- date and time of the accident;
- names and addresses of the witnesses:
- the name and department number of the police officer, who recorded the accident.
10.8 The insurance is only valid during the Rental period. Any damage caused outside of the Rental period will be covered by the Renter.
10.9 Any damage caused to the vehicle during the Rental period, which is not covered by the insurance company, will be compensated by the Renter.
10.10 If a vehicle is more than ten (10) years old or drove over 100,000 Km the excess kilometer fee will be charged in case of the vehicle broke down. The excess kilometer fee must be paid by the Owner if the vehicle was being used correctly before it broke down, and by the Renter if the breakdown was caused by incorrect use of the vehicle during the Rental period.
10.11 In the event of a flat tyre, the following charges will be applied to the parties:
10.11.1 In case of a puncture, the Renter will be fully responsible for replacement. If there are two tyres, which must be changed, the Renter shall pay the replacement of one tyre and 50% of the cost of the second tyre.
10.11.2 If there is no spare wheel in the vehicle or device for repairing a puncture, it is the Owner’s full liability to pay for the repair services.
10.11.3 In case of loss of the key during the Rental period, the Renter shall pay the full cost of the production of a new key, and (in case of the Owner’s request) the cost of change of the lock.
10.11.4 In the event of a claim the Excess is 3000 Baht
10.11.5 In the event of making a claim, you have to report the problem to Rent a Car Club, sending an email to firstname.lastname@example.org within 24 hours from the end of the rental agreement. And in the event of theft, car owners also must file a report with the police within 24 hours from the end of the rental agreement to be covered by Viriyahs insurance policy.
11. PERSONAL DATA
11.2 We collect information from you when you create an account on our Website or sign up for our Services; fill out a form and submit it to us in any manner; complete a survey for us; participate in a contest or other promotion sponsored by us or on our behalf; contact us; or otherwise use the Website or provide any information to us.
11.3 The following data may be collected on our Website: name; date of birth; gender; business/company name; job title; profession; contact information such as email addresses and telephone numbers; demographic information such as post code, preferences and interests; financial information such as credit / debit card numbers; IP address (automatically collected); web browser type and version (automatically collected); operating system (automatically collected); a list of URLs starting with a referring site, your activity on the Website, and the site you exit to (automatically collected).
11.4 Any of the information we collect from you may be used in one of the following ways:
- To respond to your requests and to keep you informed of updates about your account;
- To personalize your experience with the Website or the services;
- To improve the Website and the services;
- To manage your account;
- To improve customer service;
- To improve your experience using our partners’ services;
- To process transactions;
- To provide you with targeted offers, promotions and advertisements;
- To send periodic emails;
- To protect your rights, our rights and the rights of others.
12. MINIMUM/MAXIMUM AGE LIMITATIONS
12.1 Generally, the minimum age limit for car hiring is 21 years. Renters cannot be beyond 65 years of age. For any extra charge in case of deviation in age limit or a change in car rental age policy, please refer to the Terms and Conditions of the vehicle’s Owner. For any query regarding age requirements while renting a car, please get in touch with our team as well.
13. CHILD SEATS AND SPECIAL REQUESTS
13.1 Child seats, roof racks and extra items may be provided by the Owner on making a request. Child seats are obligatory for Renters driving with the small-aged person. Make a note that rear seat belts might not be provided in all vehicles. For any such request you must contact the car’s Owner before the Rental period.
14. TERMINATION OF MEMBERSHIP
14.1 Every user may terminate their membership at any time by giving Rentacarclub.com a written notification.
14.2 Any termination note shall be deemed accepted, and the membership of the user shall be terminated only after the end of all of the bookings with the participation of the user.
14.4 In case of termination of the membership because of violation of these Terms, Rentacarclub.com shall have no obligation to refund or pay any fee to the user, whose account was blocked.
15. DRIVING AREAS
15.1 Driving areas must be agreed with the Owner. If you intend to drive outside the driving area, you must inform Rentacarclub.com and obtain the Owner’s resolution. If you want to travel to another country you must notify us about it at the time of booking, since crossing the country has its own conditions and restrictions, which may vary. Local charges might apply and extra documents might be required for travel to certain countries.
16. VIOLATIONS OF THE TERMS
16.1 Rentacarclub.com has the right to investigate, pursue, and prosecute violations of these Terms.
16.2 In case of any violation of these Terms Rentacarclub.com has the right, at any time and without prior notice, to remove or disable access to any content of the Website, at its sole discretion.
17. LIMITATION OF LIABILITY
17.1 Rentacarclub.com will not be liable for:
- the material displayed by users on the Website;
- validity of documents provided by users;
- any failure of the Renter or the Owner to perform their obligations;
- any personal data disclosure caused by third parties;
- any harm resulting from a use of any part of the Website or the services;
- any damage caused to the vehicle by users or third parties;
- interaction of the harmed user with any other user or third party.
18. INTELLECTUAL PROPERTY RIGHTS
18.1 Intellectual property rights for any part of the Website (including content added by the users) belong to the owner of Rentacarclub.com – Rent A car Club Company Limited
18.2 Using of the Website’s content in purposes other than using Our services without a prior written consent of Rent A car Club Company Limited is strictly prohibited and may be subject to the lawsuit.
18.3 By posting any data on the Website users confirm that the material they give is their intellectual property, and they do not violate any others intellectual property rights in any way.
18.4 By posting any material on the Website users give their permission to Rentacarclub.com to use such material in any way in order to provide their Services.
19.2 Before Cookies are placed on a user’s computer or device he/she will be shown a pop-up message requesting their consent to set those Cookies. Users may, if they wish, deny consent to the placing of Cookies; however, certain features of the Website may not function fully or as intended.
20. GOVERNING LAW
20.1 These Terms shall be governed by and construed in accordance with the laws of Thailand.
21.1 Any official notice given to Rentacarclub.com regarding these Terms must be sent by email email@example.com or to Our legal address: Rent A car Club Company Limited, 64/70 MU 12, NONG PRUE, BANG LAMUNG, CHON BURI.
21.2 The invalidity, cancellation, unenforceability or illegality of any provision of these Terms shall not lead to invalidity, cancellation, unenforceability or illegality of the other provisions. In case of invalidity, cancellation, unenforceability or illegality of any provision of these Terms Rentacarclub.com will do everything possible to replace such provision causing least harm to all of the parties.
21.3 Any delay in provision or failure to exercise any right must not be deemed as a waiver of that right or any other right.
21.4 These Terms are for the Rentacarclub.com’s benefit only. However users have the right to enforce any of these Terms in order to protect their rights according to law.
22. FEES AND CHARGES
22.1 Owner’s fee:
- Rentacarclub.com’s charge is 20% of the total amount of rental price received by the Owner.
22.2 Renter’s fee:
- Rentacarclub.com’s charge is 10% of the total amount of rental price provided by the Owner.
22.3 Additional charges and fees:
- 10% of total rental price (which addresses costs of Rentacarclub’s assistance)10%-
